Pharmacy Terms

Hims & Hers UK Limited (‘Hims & Hers UK’) operates the online platform that connects you with licensed clinicians and our partner pharmacies (each a “Pharmacy", and collectively, the “Pharmacies”).
Hims & Hers UK facilitates the prescribing process, and the dispensing and delivery of your Product by the Pharmacy, but it does not itself dispense or supply medicinal products.
Partner Pharmacies
These terms of service (referred to as the “Pharmacy Terms”) apply to the supply and delivery of prescriptions for products (“Products”) dispensed directly to you by our partner pharmacies, which include:

Dispensing & Supply
The Pharmacies dispense products on prescription (referred to as the “Products”) directly to you. The Pharmacies will not dispense Products to anybody on your behalf.
Your Product may be dispensed by either of our partner Pharmacies. The Pharmacy that fulfils your prescription will depend on operational and clinical considerations, including medicine availability, regulatory requirements, and dispensing capacity at the time your prescription is issued. The Pharmacy responsible for dispensing your Product will be identified on the pharmacy dispensing label affixed to your Product.
As further outlined in the Hims & Hers UK Terms and Conditions found here, your agreement for the supply of the Products is directly with the Pharmacies. Hims & Hers UK is not a party to the Pharmacy agreements and acts solely as a facilitator between you, the Clinician, and the Pharmacy.

Dispensing Conditions
The Pharmacies will only dispense Products to you if: (i) a valid prescription has been issued and authorized for the Products by a licensed Clinician based upon an online consultation and medical assessment; (ii) payment for the Product has been received by Hims & Hers UK (acting as payment facilitator on the Pharmacy’s behalf); and (iii) the dispensing Pharmacy has reviewed the prescription and completed the required legal and clinical checks.
The Pharmacies will send Products to you promptly following the completion of items (i)-(iii) above. You will receive an order confirmation email from Hims & Hers UK Customer Support with further details on the Product.
Dispensing, Delivery, and Support
Your agreement for the supply and delivery of Products is between you and the dispensing Pharmacy. We are not a party to that agreement and do not assume responsibility for the dispensing, supply, delivery, or any other obligations arising from it.
The Pharmacies are responsible for dispensing and delivering Products in accordance with applicable pharmacy regulations. You will receive your Products directly from one of the following Pharmacies, via postal and delivery services provided by third-party couriers, as identified on the pharmacy dispensing label affixed to the Product.
The Pharmacy is not liable for any delay or failure in performance caused by circumstances beyond its reasonable control, including, without limitation, delays due to back orders or issues with postal and delivery services provided by third-party couriers.
As part of our facilitation role, Hims & Hers UK provides customer support and will liaise with the relevant Pharmacy if you have any questions or concerns about the status, delivery, or condition of your Product. If you do not receive the Product within 30 working days of the order confirmation, please contact Hims & Hers UK Customer Support at support@forhims.co.uk or support@forhers.co.uk.
Returns, Remedies, and Statutory Rights
The Pharmacies do not accept returns of any Products. However, if a Product has been dispensed in error (for example, it does not match your prescription), please contact Hims & Hers UK Customer Support, and we will liaise with the relevant Pharmacy to help address the issue in accordance with the Pharmacy’s obligations and your statutory rights.
Your Responsibilities
You confirm that all information you have provided to Hims & Hers UK in relation to your medical condition is complete, accurate, and truthful.
You must carefully read the Patient Information Leaflet that accompanies the Product before use and follow the instructions provided by your prescribing Clinician and the Pharmacy.
The Product is dispensed to you to treat a specific condition applicable only to you and must not be shared with or used by any other person.
You must notify your general practitioner or primary healthcare professional about your use of the Product.
General Terms
You may not assign any of your rights or obligations under these Pharmacy Terms to any other person. Hims & Hers UK and the Pharmacies may assign or delegate their rights and obligations under these Pharmacy Terms where permitted by law. No delay or failure to exercise any right under these Pharmacy Terms will operate as a loss of that right.
These Pharmacy Terms should be read together with the Hims & Hers UK Terms and Conditions, which govern your use of the platform, consultations, subscriptions, payments, and all other services not related to the dispensing and supply of Products. If there is any inconsistency between the two, these Pharmacy Terms govern matters relating to the dispensing and supply of Products, and the Hims & Hers UK Terms and Conditions govern all other matters.
These Pharmacy Terms, and any dispute arising from them, are governed by English law, and the courts of England have exclusive jurisdiction.
